Welcome to Medalized. These Terms & Conditions (“Terms”) govern your access to and use of the website https://medalized.com/ (the “Site”) and the services, products, and features offered through it (collectively, “Services”). By accessing, browsing, or placing an order with Medalized, you agree to these Terms. If you do not agree, you should not use the Site or place an order.

1. Definitions

  • “We”, “Us”, “Our”, “Medalized” refers to the operator of the Site and provider of the Services.
  • “You”, “Your”, “Customer”, “User” refers to any individual or entity who accesses the Site, browses products, places an order, or uses any of the Services.
  • “Products” include all medals, trophies, plaques, bespoke awards, emblems, and other items sold via the Site.
  • “Order” means a request by you to purchase Products via the Site, subject to acceptance by Medalized.
  • “Content” refers to all text, images, graphics, logos, videos, designs, and other materials displayed on the Site.

2. Acceptance of Orders & Pricing

  1. Order Acceptance
    • Your submission of an Order does not constitute acceptance. We reserve the right to reject or cancel your Order for any reason (e.g. product out of stock, errors in product information, inability to deliver to your location).
    • If we reject or cancel your Order after you have paid, we will refund you in full.
  2. Product Descriptions & Pricing
    • We strive to present accurate descriptions and images of Products. However, we do not warrant that all descriptions or images are error-free, complete, or current.
    • Pricing is subject to change without notice. All prices are displayed in the currency shown on the Site and are inclusive or exclusive of taxes/shipping as specified.
    • You are responsible for paying any applicable taxes, duties, or customs fees for orders delivered to your country.

3. Payment Terms

  • Payment must be made in full before dispatch, using the payment methods available on the Site.
  • In case of failed payment or chargeback, we may cancel your Order or suspend your access to Services.
  • We are not responsible for any bank transfer fees or currency conversion charges incurred by you.

4. Shipping, Delivery & Title

  1. Shipping & Delivery
    • We will use commercially reasonable efforts to deliver Products by the estimated delivery time, but all delivery dates are estimates only.
    • Risk of loss passes to you when we hand over the Products to the shipping carrier.
    • If the carrier loses or damages the item, you must file any claim with the carrier. We may assist, but liability is limited.
  2. Title
    • Title to Products passes to you upon full payment and dispatch.

5. Returns, Refunds, & Cancellations

  • Because many Products are custom, bespoke, or personalized, they are non-returnable once production has begun, unless due to our error or defect.
  • If you receive a defective or incorrect Product, you must notify us within [X days] of receipt with evidence (e.g. photos). We will, at our discretion, repair, replace, or refund.
  • You may cancel an Order before production starts. Once production has commenced, cancellation is not permitted.

6. Intellectual Property

  • All Content on the Site (designs, graphics, logos, layout, etc.) is owned or licensed by Medalized and protected by copyright, trademark, and other laws.
  • You may not copy, reproduce, modify, distribute, display, or commercially exploit any Content without our prior written consent.
  • By submitting materials to us for customization (e.g. artwork, logos), you represent and warrant that you own or have the rights to use those materials and grant us a license to use them in fulfilling your Order.

7. User Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Interfere with, disrupt, or attempt to gain unauthorized access to any portion of the Site or our systems.
  • Upload or transmit viruses, harmful code, or anything that disrupts the Site.
  • Use automated systems (bots, scrapers) to access or interact with the Site without permission.

8. Disclaimers & Limitation of Liability

  1. Disclaimer of Warranties
    • The Site and Services are provided “as is” and “as available,” without warranties of any kind (express or implied).
    • We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
  2. Limitation of Liability
    • To the fullest extent permitted by law, Medalized’s aggregate liability for any claim arising from or relating to these Terms or the Services is limited to the amount you paid us for the relevant Order.
    • In no event will we be liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, loss of data, personal injury) arising out of or related to your use of the Site or Products.

9. Indemnification

You agree to indemnify, defend, and hold harmless Medalized and its officers, directors, employees, agents, affiliates, and partners from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your breach of these Terms.
  • Your violation of any rights of third parties (e.g. intellectual property, privacy).
  • Your misuse of the Site or Services.
